Reasons for claim denial and what to do next

Sometimes when you file for Social Security Disability benefits in Ohio, you receive a denial of your initial claim. At Manring & Farrell, we understand how disappointed and frustrated this can make you feel. However, this is not the time to give up. You may still be eligible to collect benefits, and you have the right to appeal the decision.

Unlike SSI, eligibility for Social Security Disability is not dependent on financial need. Rather, your work history and the taxes you have paid earn you the right to collect. However, it is not always clear from your initial claim that you have earned that right. When the Social Security Administration denies your claim, one of the following reasons is probably behind the decision.

Incomplete work history

The forms that the SSA provides you to file your claim do not always allow you the opportunity to provide all the information relevant to your work history. Therefore, the SSA may get an incomplete or inaccurate picture of your work history from the paperwork. Through the appeal process, you can provide the relevant information needed to allow the SSA to better understand your background and make a more informed decision.

Younger workers may become disabled just as older people sometimes do, but the SSA sometimes makes the erroneous assumption that you are still able to work if you are under the age of 50. Your appeal can demonstrate to the SSA that your age and your disability are separate considerations.

Lack of medical proof

Your medical record should contain the pertinent documentation to demonstrate to the SSA that your disability prevents you from earning a living. Sometimes, however, the SSA does not receive the necessary medical information. It is possible to track it down and submit it during the appeal process.

It is best to file an appeal sooner rather than later to minimize the amount of time that you have to go without benefits. More information about appealing your SSD case is available on our website.
